Introduction
Entry and participation in LINE MILEAGE (“Contest”) and the issuance/acceptance of Friendship Points (“Prize”) shall be deemed an unconditional and irrevocable acceptance of these T&C. All entry instructions and any other specific details relating to the Contest or the Prize form part of these T&C (but in the event of any conflict or inconsistency, these T&C shall prevail).
These Terms and Conditions (”T&C”) shall be binding on all persons taking part in the Contest including their guests if applicable, (”Participant(s)”) operated by LINE Plus Corporation (“LINE”), its sponsor(s) or any company, website owned or controlled (directly or indirectly) by LINE from time to time.
All decisions of LINE in any matter under these T&C shall be final and no discussion or correspondence will be entertained.
Failure by LINE to enforce any of these T&C in any instances will not give rise to any claim by any person.
LINE reserves the right to amend these rules at any time at its sole and absolute discretion.
The Participant has made certain representations and warranties to LINE (both in these T&C and otherwise) in entering the Contest. LINE has relied on the accuracy and truth of such representations and warranties in granting a place to the Participant. Should LINE or its agents become aware of any fraud, deceit or similar action undertaken in connection with the Contest or otherwise, or any act or omission which might have (in LINE ’s opinion, which shall be final) an adverse effect on the Contest, LINE reserves the right to forfeit the Participant’s place in the Contest (without giving any reason and without notice).
The Participant agrees to co-operate with and comply with all reasonable requests of LINE and its agents and employees (and in particular the health and safety team) in connection with the Contest and its broadcast.
Eligibility to enter Contest
All Participants must be 18 years and above at the time they entered the Contest and a citizen of Malaysia and/or permanent resident of Malaysia and, if requested by LINE, shall provide evidence. In the event the participant is below 18 years old their participation must be supervised by their parents or legal guardian.
LINE reserves the right to disqualify a Participant in the Contest if LINE learns of the Participant’s ineligibility after awarding the Prize. Any Prize awarded shall be recovered fully by LINE.
The Contest
The interests and good reputation of LINE are paramount and LINE may, at its sole discretion, withdraw a place or require a Participant to cease to have any involvement in the Contest if it believes it is in the best interests of LINE to do so. In particular (without limitation), LINE reserves the right to immediately withdraw a Participant’s place in the Contest or the Prize if it believes the Participant to be in breach of any of its obligations, or representations and warranties, under these T&C or otherwise conducts herself in a manner which is inappropriate or unsuitable (in the discretion of LINE). The Participant shall be responsible for any additional costs in this respect
LINE will not be legally bound by any act/omission of the Participant, which might bring LINE into disrepute.
The Participant represents and warrants that s/he does not have any criminal convictions or criminal record and has not undertaken any past act or conduct which could affect the reputation of the Contest or LINE.
The Participant will comply with the instructions and directions of LINE (failure to do so may lead to immediate disqualification, at LINE’s direction).
Incomplete or indecipherable entries will be void (at LINE’s absolute discretion).
All costs, fees and/or expenses incurred or to be incurred by the Participant in relation to the Contest and/or to claim the Prize(s), which shall include but not limited to the costs for issuance of BCARD, cellular data costs, personal costs and/or any other costs, are the sole responsibility of the Participant.
Late entries will not be entertained accepted (in LINE’s discretion).
LINE has the exclusive right, to withdraw the Contest with immediate effect by announcing via LINE Event Official Account (in the case of LINE Event Official Account competitions) without any liability in respect thereof.
In the event of unforeseen circumstances, LINE reserves the right to offer alternative Prizes of equal or greater value.
LINE shall not be responsible or liable for any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending an message as a result of any network, communication or system error, interruption or failure experienced by the participating smartphone operators and by LINE or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption or failure, LINE shall not be responsible or liable for any failure to participate in the Contest at any time.
The Contest is only available for Android & iOS LINE Users with a registered Malaysian phone number residing in Malaysia. Participants using SIM cards from countries other than Malaysia or those that have not yet registered their phone number within LINE will not be recognized.
The Participant must abide by all laws and regulations currently in place and the terms and conditions of the party(ies) arranging and/or providing the Prize and the terms and conditions attached to the Prize, if any.
One (1) Friendship Point is awarded to the Participant’s LINE account for every One (1) message a Participant sends to a friend on LINE. The maximum Friendship Points a Participant can accumulate is limited on a per day basis and is set and controlled entirely at the discretion of LINE. Daily limit of collectable Friendship Points may change without prior notice.
Only successfully delivered text and sticker messages qualify as Friendship Points. Sending a message to an Official Account will not be considered valid.
Messages that had been already delivered before the Event Period or after the Termination of the Event will not be recognized and therefore will not qualify for Friendship Points.
Collected Friendship points are valid for one (1) year from the point of issuance.
The points are synchronized with the Participant’s LINE account; if the Participant changes his/her mobile device, he/she must transfer his/her LINE account to load previously acquired points. Removal of LINE ID or deletion of LINE application without proper migration of the Participant’s account will result in the loss of Friendship Points. LINE will not be responsible for lost Friendship Points resulting from the Participant’s removal of LINE ID deletion of LINE application.
The Prize is non-transferable to a third party and is not exchangeable for cash consideration. In the event that a Prize is unavailable, LINE may, in its sole discretion, substitute a reasonable replacement for any of the Prizes at any time at the time.
In cases where Friendship Points had been inadvertently credited to the Participant’s account, LINE reserves the full right to undo the credit at its own discretion without any prior notice to the Participant.
The Prize
In order to transfer the Prize to BCARD, the user must have collected more than 1,000 Friendship Points and have registered a BCARD Account within LINE. Friendship Points will only be transferrable in 1,000 Point increments. LINE reserves the full right to alter the increment amount without any prior notice to the Participant during the term of the Contest.
One (1) Friendship Point will be recognized and transferred into One (1) BCARD Point (1:1 ratio). LINE reserves the full right to alter the transfer ratio without any prior notice to the Participant during the term of the Contest.
At the point of transfer, 1,000 Friendship Points will be deducted and the transferred amount will be recognized in “My Points History”. LINE is not subject to any liability or guarantee arising from unrecorded transfers.
Friendship Points cannot be refunded once they have been transferred to BCARD Points. LINE is not responsible for Friendship Points inadvertently transferred into incorrect BCARD Accounts due to Participant’s error.
At the point of transfer, the Participant is henceforth bound by the terms and conditions of BLoyalty Sdn Bhd, which can be found at http://www.bcard.com.my/v3/?page_id=708. Any dispute in relation to BCARD Points or any terms and conditions in respect thereof shall be settled directly between the Participant and BLoyalty Sdn Bhd. LINE will bear no responsibility for resolving any dispute and the Participant must liaise directly with Bloyalty Sdn Bhd and not LINE in this regard.
LINE reserves the right to substitute or replace the Prize with one of equal or greater retail value. No complaints will be entertained on such matters.
LINE is not subject to any liability or guarantee arising out of the use of the awarded Prizes. LINE is not liable in any way for any costs, damages, loses, injuries suffered by winner.
LINE – exclusion of liability
LINE is not liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the Contest or Prizes other than those costs and expenses specifically provided for in the Prize (if any).
LINE accepts no liability (and excludes all liability) for any loss of profit, business, contracts, revenues or anticipated savings or for special, direct, indirect or consequential loss of any nature howsoever arising.
LINE shall not be liable to perform any of its obligations under the competition or in respect of the Prizes where it is unable to do so as a result of circumstances beyond its control and shall not be liable to compensate Participants in such circumstances.
General
The Participant undertakes the Contest at their own risk and agrees to indemnify LINE and its employees against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors fees) and any claim arising from the Participant’s own actions in any way in connection with the Contest, the Prize or a breach of the Participant’s obligations hereunder.
There is no fee payable to the Participant in respect of her involvement in the Contest.
The Participant is obliged to take all reasonable steps to ensure the safety standards and the general appropriateness of activities undertaken during the Contest and acknowledges that all activities are undertaken at her own risk.
LINE is not liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the Contest. This limitation does not exclude any liability for negligence by LINE or death or personal injury arising out of such negligence.
These T&C shall be governed and construed in accordance with South Korean Law.
These T&C represent the entire agreement between the parties relating to the Contest (unless otherwise expressly confirmed in writing by LINE) and supersede all prior representations, agreements, negotiations or understandings (whether oral or in writing). Except as specifically set out herein, all conditions, warranties and representations expressed or implied by law are excluded. For the avoidance of doubt, no information of any nature about the Contest or the Prize or any of these T&C should be relied upon unless confirmed in writing by LINE. The invalidity, illegality, or unenforceability of the whole or part of a T&C or Condition does not affect or impair the continuation in force of the remainder of the T&C.
The failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies. These T&C shall be governed by and interpreted in accordance with South Korean law and the parties irrevocably submit to the exclusive jurisdiction of the South Korean courts.
